Acceptable Use Policy

All Dedicated Server Enterprise (referred to herein as “DSE”) colocation, dedicated server, DSE customers are bound by the following Acceptable Use Policy (AUP). All DSE users are required to comply with this policy, along with any and all applicable laws and regulations in full. This is in addition to any terms and conditions of applicable agreements.
DSE values itself as a responsible hosting provider and strongly discourages irresponsible practices, which degrade the usability of network resources and thus the value of Internet services. This AUP specifies the actions prohibited by DSE. DSE reserves the right to modify this AUP from time to time, without notice. Users are encouraged to consult this site periodically for the latest updates and modifications.

Doing, causing or allowing (whether by act or omission) any of the following, and/or any direct or indirect aiding or abetting of any person or entity to do, cause or allow (whether by act or omission) any of the following, is considered a violation of DSE’s AUP and of the Terms of Service Agreement (“TOS Agreement”) between DSE and Customer.

1) Virus, Trojan and Malware Distribution
Use of DSE’s service to distribute Virus or any other forms of data which can cause considerable harms to any network. Using or storing any type of software which is designed to or is likely to abuse or negatively impact Internet service, including, but not limited to, portscanners, hacking tools, ping flooding programs, security/root exploits, packet sniffers, and spam software.

2) Cracking/Hacking
Attempts to access accounts or systems other than the user’s own accounts or systems or an account or system that the user has been explicitly authorized to access is illegal under federal and state law.

3) Harassment
Use of DSE’s services to harass or threaten (in the legal sense of those terms) any other person is prohibited.

4) Fraud
Using DSE’s services in furtherance of or involving any fraudulent activity or fraudulent purpose, or to make any fraudulent offers to sell or buy products, items or services, or to advance any type of financial scam including, but not limited to, pyramid schemes, chain letters or any other financial scam.

5) Child Pornography
Child pornography includes related material, such as simulated child pornography, non-nude child pornography, or sites linking to such material, whether it is determined to be legal or not. Offenses of this nature will be reported to the federal authorities and prosecuted to the fullest extent of the law. Customer is held fully responsible for any misuse of account regardless of whoever committed the act.

6) Spam
Using DSE’s services to: transmit (by email, uploading, posting or otherwise), distribute, download, copy, cache, host or store on a server any spam, Customer shall not transmit unsolicited commercial e-mail (UCE), or unsolicited bulk messages (Spam), including advertisements, informational distributions, and charitable or other solicitations.

7) Forgery/Impersonation
Publishing or disseminating information that publicizes the personal information of a person without consent thus violating such person’s privacy rights, forging the signature or other identifying mark or code of any other person and impersonating or assuming the identity or any other person is forbidden.

8) Terrorism Activities
Use of DSE services to promote terrorist activities which including and not limiting to forums for terrorists, personal websites for terrorists, audio, photo and videos of terrorist activities.

9) Gambling
Using DSE servers to promote gambling is prohibited.

10) Defamatory or Abusive Language
Using DSE servers as a means to transmit or post defamatory, harassing, abusive, or threatening language. Any content that is discriminatory based on gender, race, age and/or promotes hate or violence is prohibited.

11) Termination of Services
DSE reserves the right to disable and terminate service to anyone who violates the AUP without given notice. Failure to comply with this AUP may result in termination of your account with no refund at our sole discretion. DSE is not responsible for any damages or losses resulting from the termination of service.

12) Unmanaged Server
By default all the server on DSE is under unmanaged services means DSE only provide the server with the fresh Operating System. We do not support for any 3rd party software like: cPanel, Direct Admin, mail system, etc. For the 3rd party software the clients are agreed to consult with the service provider.

13) Managed Server
DSE only provide the security hardening, update kernel, setup the cPanel, managed all the server issues. The clients are agreed to do their own backup as well, as we do not responsible for any loss of data.
